Can I file my I-140 and I-485 together?

If your priority date is current, you are able to file your I-140 and I-485 together.  This will not affect the outcome of your I-140, but if your I-140 is ultimately denied, your I-485 will be automatically denied and you will lose your filing fee for your I-485.  Also, if you apply for an EAD and/or AP based on your I-485 and use either, your current NIV status will be invalidated.  You can stay in the US based on your pending I-485, but if the I-485 is denied, you will have to get another NIV status or leave the US.
