In order for you to be eligible for an H-1B visa, you need (1) a job offer from a U.S. employer for the types of jobs covered by H-1B visa (specialty occupation, fashion model, or services for DOD projects), and (2) the required background for the job (explained below).

Required Background for Specialty Occupation

In order for a foreign worker to qualify for a specialty occupation, the foreign worker must meet one of the following requirements:

  • The foreign worker has a U.S. Bachelor’s degree or a higher degree required by the specific specialty occupation (e.g., an engineering degree if an engineer) from an accredited college or university;
  • The foreign worker has a foreign degree from an accredited college or university, and the degree is determined to be equivalent to a U.S. Bachelor’s degree or a higher degree required by the specific specialty occupation (see below for information about how to determine the equivalency);
  • The foreign worker has an unrestricted state license, registration, or certification which authorizes him/her to fully and immediately practice the specialty occupation in the state of intended employment; or
  • The foreign worker has education, specialized training, and/or progressively responsible experience that are equivalent to the completion of a U.S. Bachelor’s degree or a higher degree in the specialty occupation, and the foreign worker’s expertise was recognized through progressively responsible positions directly related to the specialty. See below for how to determine this equivalency.
